ESITY s.r.o. (hereinafter referred to as "ESITY" or "we") attaches great importance to the protection of personal information of users. We may collect and use your information when you download, open, browse, register, log in, use the "ESITY" related websites, software and related products and/or services. We hope that through this Privacy Policy we will explain how we collect, use, store and share this information, and how we provide you with access, updates, control and protection. This Privacy Policy is closely related to the ESITY products and/or services you use. When we provide products and/or services, we may collect and store the following information about you. If you do not provide relevant information, you may not be able to register as a user or use and enjoy some of the products and services we offer, or you may not be able to achieve the desired results of the products and/or services.

1.1.1 To use any of the ESITY products and/or services, you must become a regular member of ESITY. When you register for an ESITY account or use the products and/or services offered by ESITY, you will need to provide us with your name, mobile number and other personal information as well as other necessary information that we ask you to provide. We will verify your identity information as required by law of some countries. We will encrypt this data in a secure server.

1.1.2 In order to provide you with comprehensive products and/or exclusive services, ESITY may ask you to provide your or student's name, e-mail address, physical address, gender, language, age and other personal information. ESITY needs these Data to quickly and easily provide you with relevant products and/or services, and continuously optimize this product and/or service content to meet your needs better.

1.1.3 With your prior consent, ESITY may also ask you to provide your or your student's resume data (such as career, education, student's age and gender) in order to enhance ESITY's products, services, promotion and marketing effectiveness. ESITY may use such personal resume data to produce an overall report on the user base. Such personal resume data and overall reports are in an anonymous form and do not contain content that identifies you or the student.

1.1.4 When purchasing any products and/or services, if you choose to pay by credit card or bank card, you need to provide us with your credit card or bank card information when you choose a specific payment method, so that you can purchase our products and/or services. During your payment process, ESITY will provide third parties with private information about your personal credit card or bank card. When you pay directly to the third-party payment page, these third parties will collect your payment information directly. 1.2 When you use ESITY products and/or services, we obain your information and we may collect the following information:

1.2.1 Log in information means technicl information that our system may automatically collect through cookies, web beacons or other means when using our products and/or services, including:

a) device or software information, such as configuration information provided by your mobile device, web browser or other programs used to access our products and/or services, version of the mobile device and device identification number, location of the device information (such as IP address, GPS location, and Wi-Fi access points that provide relevant information, sensor information such as Bluetooth and base stations), etc.

b) information that is searched or viewed while using our products and/or services, such as the web search terms you use, the social media page url address you visit, and other browsing or requesting information when you use our products and/or services. Information and content details, etc.

c) information about the mobile applications (APP) and other software you have used;

d) information abou your communication through our products and/or services, such as the account number of the communication, as well as the communication time, data and duration;

e) information (metadata) contained in the content you share through our products and/or services, such as the date, time or location of the photo or audio or video recorded or uploaded.

1.2.2 Location information, including information provided by you or other users when using ESITY products and/or services that include your geographic location.

1.2.3 In order to provide you with comprehensive products and/or exclusive services, the information recorded by the system when you use our products and/or services, such as course audio and video recording.

2 How do we store your information?

Personal information collected and generated by us during our operations is stored in our and Google servers and protected in accordance with laws and regulations and this Privacy Policy.

3. How do we use cookies and similar technologies?

3.1 We or our third party partners may collect and use your information through cookies and store such information as login information.

3.2 We use our own cookies to provide you with a more personalized user experience and products and/or services for the following purposes:

3.2.1 To remember your identity. For example, cookies help us identify you as our registered user, or save information about your preferences or other information that you provide to us;

3.2.2 Analyze your use of our products and/or services. For example, we may use cookies to understand what acivities you use with our products and/or services, or which pages or products and/or services are most important for you;

4.1.7 Software certification or management software upgrade;

4.1.8 To allow you to participate in surveys about our products and/or services, or promotions;

4.1.9 Other uses as agreed by you.

4.2 In order to give you a better experience, improve our products and/or services or other uses that you agree to, we may collect information through a certain product and/or service, subject to relevant laws and regulations, for the purpose of bringing together information or personalizing, for our other products and/or services. For example, information collected when you use one of our products or services may be used to provide you with specific content in another product or service, or not to show you information that is not universally relevant to you. If we provide the option in the relevant product and/or service, you may also authorize us to use the information colleted and stored by the product and/or service for our other products and/or services.

4.3 In order to provide you with comprehensive products and/or services to enhance your user experience, after collecting your presonal information, we may analyze and commercialize the user database. We will follow the laws and regulations and the legally necessary principles, and take necessary security measures for relevant information, such as de-identifying data by technical means.

5. How do you access and control your personal information?

5.1 You can log in to your account at any time to view or modify your account settings and information. If you wish to change, update or delete your personal information retained in our system, you only need to log in to your ESITY account, open the profile settings or contact us via online consultation to make changes. We will do everything possible to take appropriate technical means to ensure that you have access to, update and corect your registration information or other personal information provided in connection with the use of our products and/or services. When accessing, updating, correcting, and deleting the above information, we may ask you to authenticate to protect your account.

5.2 You can also contact us by calling our online consultants to cancel the ESITY account. If you find that we have violated laws and regulations or this policy stipulates that we collect and use your personal information, you can contact us through online consultation and ask us to delete the relevant personal information. We will take measures to delete or anonymize the relevant personal information or De-identification processing. After you have voluntarily canceled your account, we will stop providing you with products or services, remove your personal information, or anonymize or de-identify it as required by applicable law.

5.3 During your use of our products and/or services, we will do everything possible to ensure that you have access to the information in your account. If the information in this account is incorrect, we will endeavour to provide you with a variety of ways to quickly update or delete information in your account (unless we have to retain it for legitimate business or legal reasons).

c) to fulfil the rights and obligations in the ESITY User Registration Agreement, the ESITY Course Services Agreement and this Privacy Policy and other contracts or rules between us and you;

d) to understand, maintain and improve our products and/or services.

6.2 Because our foreign teachers and cooperative third-party service providers are often from other countries, the presonal information we collect may be accessed or obtained by the overseas institutions or individuals, and we will strictly abide by relevant laws. The requirements of the regulations ensure the safety and integrity of relevant personal information.

6.3 In order to provide better customer service and user experience, we may provide your presonal information with the above third parties. We will only provide your personal information for legitimate and necessary purposes and will only provide the personal information necessary for the relevant products and/or services. We will endeavor to ensure that such third parties use these personal information in accordance with this Privacy Policy and other appropriate confidentiality and security measures that we require to comply with, and expressly require such third parties to use only the shared personal information. 7. Information security

7.1 We will only retain your personal information for the time and time allowed by this Privacy Policy (https://www.esity.net/privacy-policy)

7.2 In order to protect the security of your information, ESITY will take reasonable and necessary measures to protect your information at the current state of the art, and take phsical, technical and adminstrative security measures to reduce loss, misuse, unauthorized access, disclosure and risk of change, including but not limited to transport layer data encryption, firewall and encrypted storage, physical access control, and information access authorization control. Please understand that your information may be leaked, destroyed or lost, even if ESITY tries its best to take the above measures due to various unpredictale malicious means.

7.3 Before the credit card or bank card data is transmitted to third party via internet, the data is encrypted by the security server, At login, ESITY also insists on password authentication to prevent your profile and learning records from being accessed without authorization.

7.4 When you use ESITY products and/or services, please take good care of your ESITY account and its password, we will identify you by your account number and password. Once you have leaked your ESITY account number and password, you may lose your information and may have legal consequences for you. If you find that the ESITY account number and password have been or will be leaked for any reason, please contact our online consultation immediately so that we can take appropriate measures. However, we are not responsible for any such situation until we can take action within a reasonable time.

If such amendments result in a substantial reduction in your rights under this Privacy Policy, we will make a prominent notice on the homepage or through other means we deem appropriate (including sending you an email or notify you otherwise) before the amendments become effective. 14 Online Shop Privacy Policy

The online store ESITY on the website www.esity.net company ID […] based in Slovakia processes personal data provided by Customer to fulfill, and in addition to confirm Terms and Conditions, to process electronic orders and shipments and for the necessary communication during a period required by law.

General provisions

1. Personal data controller, in compliance with GDPR (hereinafter referred to as „Regulation“) is ESITY, company ID [….], based in Slovakia (hereinafter referred to as „Controller“);

2. The contact details of the Controller are: email: info@esity.net/shop, tel.: 00421 948 662 333;

3. Personal data is any information that relates to an identified or identifiable natural person.

The source of personal data

1. Controller processes personal data obtained with consent from Customer and collected through the contract to purchase and fulfillment of the electronic order created in the online store www.esity.net/shop.;

2. Controller processes only the identifying and contact details of Customer which are necessary for the fulfillment of the contract to purchase;

3. Controller processes personal data for the accounting purposes and for the necessary communication between the contracting parties for the duration required by law. Personal data from purchase will not be made public and will not be transferred to other countries.

Purpose of data processing

Controller processes personal data of the Customer for following purposes:

1. Registration on the website www. esity.net in compliance with Chapter 4, Section 2 of GDPR;

2. For fulfillment of the electronic order created by Customer (name, address, email, telephone number);

3. To observe law and regulations arising from the the contractual relationship between Customer and Controller;

4. Personal data is necessary for the fulfillment of contract to purchase. Contract cannot be concluded without the personal data.

Duration of personal data storage

1. Controller stores personal data for the period necessary for fulfillment of rights and obligations arising from the contractual relationship between Controller and Customer and for the duration of 3 years following the conclusion of contractual relationship;

2. Controller must delete all personal data after the expiration of the period required for the storage of personal data.

Recipients and processors of personal data

Third parties processing personal data of the Customer are subcontractors of the Controller. Services of these subcontractors are indispensable for the successful fulfillment of the contract to purchase and processing of the electronic order between Controller and Customer.

Subcontractors of the Controller are:

  • Webnode AG (online store system);
  • Google Analytics (website analytics);

Rights of Customer

In compliance with the Regulation, Customer is entitled to:

1. The right of access to personal data;

2. The right to rectification of personal data;

3. The right to erasure of personal data;

4. The right to object to processing of personal data;

5. The right to data portability;

6. The right to withdraw consent to the processing of personal data in writing or by e-mail sent to: info@esity.net;

7. the right to lodge a complaint with the supervisory authority in case of suspected breach of the Regulation.

Security of personal data

1. Controller declares to take all technical and organizational precautions necessary for the protection of personal data;

2. Controller has taken technical precautions to secure data storage spaces, in particular securing access to the computer with a password, using antivirus software and performing regular maintenance of the computers.

Final provisions

1. By placing an electronic order on the website info@esity.net/shop Customer confirms to be informed about all the conditions of personal data protection and accepts them to the full extent;

2. Customer accepts these rules by ticking the checkbox in the order purchase form;

3. Controller can update these Rules at any time. New, updated version has to be published on his website.
